1.Agreement

By using Blue Peach you agree to these terms. Blue Peach is operated by Blue Peach.

2.What Blue Peach is, and what it is not

Blue Peach is software for running a farmers market. We are not a market, we do not run one, and we are not a party to the relationship between a market and its vendors. Each market sets its own rules — its fees, its application questions, its cancellation policy, its terms for vendors. Those are the market's rules, not ours, and when you apply to a market you are agreeing to that market’s terms as well as these.

3.Accounts

Keep your sign-in details to yourself and tell us if you think someone else has them. You are responsible for what happens under your account. Give us accurate information and keep it up to date.

4.Market organisers

If you run a market on Blue Peach, you are responsible for the rules, policies and terms you publish, for the decisions you make about applicants, and for treating vendors fairly and lawfully. You decide who is approved, what they are charged, and whether they are refunded. We do not make those decisions and cannot reverse them for you.

5.Vendors

Fees are set by the market you apply to, not by us, and are shown before you pay. Sales figures you report are self-reported and we do not audit them — they are the basis on which your market calculates what you owe, and reporting them accurately is your responsibility and your market’s rule to enforce.

6.Money

  • An application fee may have two parts: the market’s fee, and a non-refundable service fee. Both are shown before you pay.
  • Nothing is ever charged automatically. A charge happens because a person pressed a button, or because you paid it yourself.
  • A market may choose to pass card processing costs on to vendors. Where it does, that surcharge is shown separately from what you owe.
  • Refunds are the market organiser's decision, not ours. Where a refund is issued, the card processing fee and the non-refundable service fee are not returned. If a refund fails at the bank, the money stays where it is and your market organiser will need to try again.
  • Payouts to market organisers are made through Stripe, and are subject to Stripe’s own terms and timing.
  • Blue Peach charges for the use of the platform. Where a payment is made through Blue Peach to a market’s own payment account — an application fee, or money a vendor owes their market — Blue Peach deducts a fee from that payment, covering card processing and a platform margin. We may also agree other charges with a market organiser, including fees relating to market days. What is charged is shown or agreed before it applies, and we will give reasonable notice before any charge changes. Deliberately, no amounts are stated here: they depend on the payment and they change.

7.Acceptable use

Do not use Blue Peach to break the law, to misrepresent who you are, to upload anything you do not have the right to upload, or to interfere with the service or other people’s use of it. Do not attempt to reach data belonging to a market or vendor you are not part of.

8.Your content

What you upload stays yours. You give us permission to store and display it as needed to run the service — for example showing your logo on a market’s public page. You confirm you have the right to upload what you upload.

9.Availability

We work to keep Blue Peach running but we do not promise it will be uninterrupted or error-free, and we may change or discontinue features.

10.Disclaimers and liability

Blue Peach is provided “as is”. To the fullest extent the law allows, we exclude implied warranties, and we are not liable for indirect or consequential losses, or for lost profits or lost data. Our total liability to you for any claim is limited to the fees you paid us in the twelve months before the claim arose. Nothing here limits liability that cannot lawfully be limited.

11.Ending it

You can stop using Blue Peach at any time. We may suspend or close an account that breaches these terms. Financial records survive the end of an account, because both sides may need them.

12.Changes

We may update these terms and will change the date above. Continuing to use Blue Peach after a change means you accept it.

13.Governing law

These terms are governed by the laws of the State of Colorado, and the courts of Colorado have exclusive jurisdiction over any dispute.
